TERMS & CONDITIONS

Welcome to Avance Media

 

We’re excited to collaborate with you across Strategy, Media, Marketing and AI. These Terms & Conditions outline the responsibilities, rights, and expectations for both parties to ensure a smooth, professional engagement.

By engaging our services, you agree to the following terms.

1. Communication
We communicate via email, phone, Google Meet or our client management system. Please provide clear and timely responses to help keep your project on schedule.

2. Bookings & Scheduling
To book our services, please contact us via phone, email, or our online booking system. All key details—including scope of work, service requirements, dates, times, and locations—must be confirmed before securing your booking.

3. Availability
We will do our best to accommodate your preferred dates; however, all bookings are subject to availability. A minimum of three (3) business days’ notice is required for new bookings.

4. Scope of Work
The scope of your project will be outlined in your proposal, contract, or briefing document. Any additional work outside the agreed scope will incur extra charges. It is your responsibility to review and confirm all deliverables before production begins.

5. Client Responsibilities
You are responsible for supplying all necessary information, materials, assets, approvals, and access to enable us to complete your project. Delays or omissions may impact the final outcome and could result in additional charges or changes to the timeline.

6. Pre-Production
All creative direction, messaging, content requirements, and outcomes must be agreed upon prior to production. Avance Media is not liable for missing content or creative elements not outlined in the approved brief.

7. Rescheduling & Weather
If a project needs to be rescheduled due to weather or other unforeseen circumstances, we’ll work with you to find a suitable alternative date at no additional cost, subject to availability. Refunds are not issued for weather-related delays.

8. Cancellations
Client cancellations must be made in writing. The 25% deposit is non-refundable. Cancellations made within 48 hours of the scheduled start may be charged up to 75% of the total fee, depending on the work already completed. If Avance Media must cancel due to illness, emergency, or other unavoidable circumstances, you will be notified as soon as possible and offered a full refund or reschedule. We are not liable for any indirect or consequential losses arising from this.

9. Payment Terms
A non-refundable 25% deposit is required to secure your booking. The remaining 75% is due before the delivery of final assets unless otherwise agreed in writing. We accept payment via bank transfer, credit card, or online invoicing. Late payments may incur a 5% monthly interest charge and could result in paused work until payment is made in full.

10. Revisions
Each deliverable includes one (1) round of revisions. Additional revisions will be billed at $150 per hour. Major changes or new creative directions may be treated as a new project.

11. Timeline & Turnaround
Standard delivery is within ten (10) business days unless stated otherwise. Expedited delivery may be available at an additional cost. Delays caused by late client feedback, missing assets, or approval delays may result in timeline extensions or extra charges.

12. Extra Time & Charges
Any work performed outside the agreed scope—including strategy sessions, production overtime, troubleshooting, or extended post-production—will be billed at $150 per hour per team member.

13. Ownership & Usage Rights
Final deliverables are released upon full payment. Until then, all content remains the intellectual property of Avance Media. We retain the right to use completed work in our portfolio, case studies, and marketing unless you opt out in writing. You may not sell, license, or redistribute final assets to third parties without written approval.

14. Storage & Aftercare
Final deliverables are stored for thirty (30) days following project completion. Ongoing or long-term storage of raw footage, working files, or creative assets is not guaranteed unless arranged in advance.

15. Technical Failures
While every precaution is taken, Avance Media is not liable for delays or content loss caused by technical failures, equipment malfunction, platform outages, or power disruptions beyond our control. In such cases, we will assist in rescheduling or finding a resolution where possible.

16. Subcontracting
We may subcontract elements of your project to trusted third-party specialists to maintain quality and efficiency. Responsibility for project delivery and final output remains with Avance Media.

17. Limitation of Liability
Avance Media is not liable for indirect, incidental, or consequential damages, including lost profits or project delays caused by external factors. Our liability is limited to the total amount paid for our services.

18. Termination Clause
Either party may terminate the agreement with seven (7) days' written notice. In this case, any work completed to date will be billed accordingly. Deposits are non-refundable.

19. Dispute Resolution
In the event of a disagreement, both parties agree to attempt resolution via negotiation or mediation before taking legal action. These terms are governed by the laws of New South Wales, Australia.

20. Policy Updates
Avance Media reserves the right to update or amend these Terms & Conditions at any time. The most current version will be made available upon request or published on our website.
